Today, the Government has approved a new EHRC Code of Practice.

This document tells service providers that they can exclude trans people from single-sex spaces.

This is unlikely to mean that trans people will be excluded routinely, but it does mean it may happen more often.
Today, the Government has approved a new Code of Practice from the EHRC. This document tells service providers that they can exclude trans people from single-sex spaces. This is unlikely to mean that trans people will be excluded routinely, especially from basic services like toilets, but it does mean it may happen more often. In response to requests from trans young people and trans adults, we’ve co-developed guidance on what the new Code of Practice means, how to assess your safety in public spaces, and what to do when challenged. Here’s what you need to know: The Code of Practice applies to organisations, not individuals. There is not going to be a ‘toilet police’, and it is not a crime to use spaces and facilities that align with your gender. It may be more likely that services will challenge trans people or ask trans people not to use single-sex spaces. It means that we will not always know if an organisation or venue is going to be trans inclusive. Ultimately, what this means is that you will need to assess and check your safety as you move through the world. This is not new - we have always needed to assess our safety in toilets, changing rooms and in spaces with strangers. Remember: • If you do not feel safe, leave. Your safety is more important than making a point. • Avoid conflict. You are under no obligation to respond to someone who tries to stop you from using a basic service. • Document your experience. The law is not settled in this area, so if you are excluded, record your experience • It is not illegal to use facilities like toilets in line with your gender, and you should not face any police action See our guidance for more information on how to check single sex space polices, what your rights are, and how you can respond when challenged.

We know there are loopholes that need to be closed, and we welcome the insight and critique.

GI is a trans community, and we would never support a bill that puts trans people at risk or allows conversion practices to continue.

👏 We did it! Today the Government have published their long overdue draft Bill to ban conversion practices.

For far too long, LGBTQ+ people have been subject to practices that seek to change or suppress who they are. Conversion practices have caused profound and lasting harm to many LGBTQ+ people.

Ban Conversion Practices Today represents a momentous step towards LGBTQ+ equality as the Government have finally published their long overdue draft bill to ban conversion practices. Everyone deserves to be free and safe to be who they are. LGBTQ+ people are not broken and they don't need fixing. After more than eight years of delays, this vital government action to protect the LGBTQ+ community from harm is long overdue.

EHRC Updated Code of Practice: GI’s response The EHRC has finalised its Code of Practice which advises services and businesses on how to interpret the Equality Act. It doesn’t change the Equality Act, but it influences how courts interpret it. We’ve taken the time to digest it and have released our full response on what the changes mean for services and trans people... The Good • Recognition of non-binary people • Recognition of trans children • Gendered groups can include trans women • No ID checks for toilets and basic services ... The bad The Code empowers those who want to exclude trans people from services and spaces and makes life harder for those who want to support trans people. Domestic violence refuges that have been supporting trans women without issue now feel they have to jump through hoops to keep supporting them legally. Businesses and workplaces are likely to go gender-neutral – sometimes at considerable cost – to avoid lawsuits. The Code treats trans people as a third sex and sets a... The Ugly Exclusionary changes have a chilling effect on trans people’s participation in public life. Creating an atmosphere of fear around basic access needs leads people to self-isolate. We are already seeing members of our community disengage from sport and physical activity, from education, and even from basic healthcare because of the overwhelming fear of exclusion...

The amended EHRC Code of Practice has been released.

Lots of people will make claims about what is and isn’t going to happen as a result, and there will be many different interpretations of the Code in the next few days. We urge everyone not to jump to conclusions.
The amended EHRC Code of Practice has been released today. This is a document that interprets the Equality Act. It has been revised since last summer, following the judgement in For Women Scot v Scottish Government. We know that the first draft of the new Code of Practice was cruel, inhumane, and discriminatory towards trans people. We campaigned for that draft to be rejected and demanded that any new version should be one that fully considered and guaranteed the human rights of all trans... Trans people deserve the same treatment as everyone else, and a Code that cheapens or weakens our rights and protections makes a mockery of the Equality Act and the principles it was built on. The revised Code will now be laid before Parliament for 40 days, after which it is almost certain to become law. Lots of people will make claims about what is and isn’t going to happen as a result, and there will be many different interpretations of the Code in the next few days...

This year’s theme is “At the heart of democracy”, a powerful reminder that truly democratic societies must have full, meaningful equity and justice for all.
IDAHOBIT Across the world Governments are pushing through authoritarian policies and exclusionary legislation that targets trans people, including the EHRC’s Code of Practice here in the UK. But our communities and allies have the power to fight back through solidarity and collective action. And our communities have the power to nurture us and bring us joy. We’ve survived regressive laws and Governments before, and we’ll do it again if we must.
