@weissmann.substack.com Hi Andrew! If Mn can gather enough evidence to charge the shooters of Renee and Alex and it gets moved to federal court, I know it will be still based on state law, but does this mean it would be a federal conviction thereby something the president could pardon?

This is wrong. 5 USC 3345(a) gives three options. He writes about only two. It’s the default option — the first assistant route — that remains open. And first assistants have long been named after a vacancy.

I think it was defiance. Wray's resignation actually narrowed Trump's options. There was a path to rapidly appointing Patel as an acting director, without Senate confirmation. That path is now closed:

I have about 1/3 of the followers here that I have on the other place, but the engagement here is a lot more fun & interesting, & it feels happy. I really hope this lasts. We need a public marketplace of ideas!
