The Mail Voting Fight Is Pushed to 2028 NEW September 15, 2026 at 8:35 am EDT By Taegan Goddard - 55 Comments • W The Supreme Court last night removed one of the biggest uncertainties hanging over the midterm elections. TALKING POINTS by Taegan Goddard In a 7-to-2 decision, the justices refused to let the Trump administration impose new Postal Service restrictions on mail voting before November. That means states can continue using the same basic procedures that have governed mail ballots in recent elections - a method used by nearly one-third of voters. For Democrats, that resolves an immediate concern. Mail voting has become especially important to their coalition and election officials had warned that imposing entirely new requirements this close to Election Day could disrupt voting already underway. But this may only settle the fight for 2026. Justice Brett Kavanaugh joined the Court in blocking the rules, saying state and local officials simply did not have enough time to implement them. Yet his concurrence also included an important caveat: He said there is "at least a fair prospect" that the Postal Service ultimately has the legal authority to impose such rules. That's worth highlighting. Trump has spent years attacking mail voting and the Court did not rule that the federal government can never impose the restrictions he proposed. Instead, it said he could not do so in the middle of an election already getting underway. So while the threat to mail voting this year is gone for this year, the larger battle may simply have been pushed to 2028.
