impact claims is not an intent-based test. It acknowledged
that §2 “does not demand a finding of intentional discrimi-

KAGAN’s charge that the majority’s new test was an intent
test in all but name. Id., at ____ (slip op., at 35). It is hard
to see how the District Court’s finding of discriminatory in-
tent under the Fourteenth Amendment could have de-

how to find discriminatory intent under the Fourteenth
Amendment. The Court’s apparently oblivious insistence
to the contrary today cannot be squared with what Callais

ICE broke the finger of a Reuters photojournalist today.
After two days of drenching people in pepper spray, people have been adding more and more layers of protection, rendering the spray useless and leading to ICE using their short metal batons that they swing with full force.

What this shows is that a staggering 63%(!) of people arrested by ICE in Minnesota during Operation Metro Surge (from December through February) had no criminal record at all.
Quick and dirty; here's ICE arrests in Minnesota by criminality, from October 2025 to early March 2026. Note the MASSIVE spike in arrests of people with no criminal record
