These cases probably weren’t going anywhere, cases against lead paint manufacturers have met with little success and these probably suffer from the same problems. That makes the Courts attempt to use them to create some sort of federal exemption for enviro cases especially disgusting.

But there might have to be a bunch of litigation that could bankrupt them, say the judges banning nationwide injunctions and forcing plaintiffs to file cases in every single district to stop unconstitutional behavior.

In the next Congress, if Democrats obtain a majority in both chambers, they should have a dedicated Supreme Court Week where the different committees mark up bills in their respective jurisdiction aimed at overturning the most egregious Roberts Court decisions.
