I am delighted to share to share my latest article, “Political Philosophy and Realism in Criminal Law Theory,” now published in the Oxford Journal of Legal Studies.

I argue that the debate between legal moralism and the political turn in criminal law theory is really about the lack of realism!

1/ Is the Drumcree determination still "live"? I keep reading accounts that it is. It depends what "live" means. There are four possible senses of "live" 🧵 Bottom line: a fresh determination will be required, even if CoA finds original determination was lawful in first place.

Hello Bluesky. Thought I'd debut with something light and uncontroversial. So: the Drumcree parade dispute.

A thread on the legal status of the Parades Commission's determination of 27 September 🧵

Thank you, @colinmurray.bsky.social for circulating this in Bluesky orbit (I'm pleased to have finally joined this place!).
Always worth listening to Stormont Sources for an informed account of NI politics, but it's very NI that you are more likely to get a discourse on "love your neighbour" than on Art 11 ECHR. Go here for a weekend read on the relevant law around parades:

Drumcree is being portrayed, where there is any rights analysis at all, as a straight clash between Art 8 and Art 11. This is problematic, as it doesn't recognise the specific protest rights of the Garvaghy Road residents (as the CAJ and FIDH highlight here):
