If they can be charged with a crime, they are under the jurisdiction of the US. That "subject to the jurisdiction thereof" is in relation to those with political immunity. Just because you enter the country illegally doesn't mean the law won't apply to you. If born on American soil, your American.

I do not think we should have an open border. I believe that if an illegal immigrant commits a crime, they should be deported. I do not believe mass deportation and ice raids at workplaces or places of education or worship is how it should be conducted. We are better than this.
