Yesterday our team tabled at the Dane County Jail Reentry Resource Fair, sharing housing resources and information with people preparing for reentry. Access to stable housing is imperative for successful reentry, and we are grateful to be part of a network working to support that transition.

Before you unpack, take pictures (and video!) of everything. Landlords can deduct from your security deposit for damage beyond “normal wear and tear.” Photo evidence protects you from paying for damage you didn’t do.

In Wisconsin, verbal agreements can count, but they are hard to prove. If your landlord promises a repair, payment plan, or change to your lease, ask for it in writing. Screenshots save stress later.

In Wisconsin, you can only use your security deposit to cover your last month of rent if your landlord agrees in writing. If you skip that last payment, you could still owe rent and risk eviction. ALWAYS get a written agreement before making that decision.

In most situations, landlords must give at least 12 hours’ notice before entering your unit (unless it is an emergency). And it HAS to be at a reasonable time.

Some termination notices give you the chance to “cure” (pay and stay). Others may not, depending on your lease and rental history. Don’t assume. Read the notice carefully, and seek help (TRC is an option)! Receiving a notice does not necessarily mean you need to vacate your unit right away.

It is illegal for a landlord to evict you, raise rent, or refuse repairs because you reported problems or exercised your rental rights. You have a right to report unsafe housing to authorities.

How does non-renewal of leases work? What kind of notices must be given? 🪧

Part 4: Non-Renewal Notices When is a non-renewal notice required? It varies depending on the type of rental agreement. In a lease with a term, notice is NOT required. Unless there is an automatic renewal provision, the lease is assumed to end on the end date. In a periodic month-to-month tenancy, written notice IS required. From landlord to tenant or vice versa, at least 28 days written notice must be given to the other party. Wis. Stat. 704.19 explains specific rules of how that notice must be given. In a tenancy at will, written notice is required in the same manner as a periodic tenancy above. Does there need to be a reason for non-renewal? What is allowed? With only some exceptions, and as long as notice was given properly, landlords and tenants do NOT have to give a reason for choosing not to renew a lease in Wisconsin. However, there are two types of reasons a landlord is not allowed to give a non-renewal notice. Discrimination means giving tenants different treatment because they are different from other tenants in a way that is protected by the government. A landlord cannot give a non-renewal, and cannot choose to not renew a lease, for reasons that are discriminatory. Retaliation means that the landlord opted to not renew a lease because a tenant asserted or attempted to assert their rights as tenants. A landlord cannot give a non-renewal, and cannot choose to not renew a lease, for reasons that are retaliatory. How must a non-renewal notice be given? A non-renewal notice must be in writing, even if the original agreement wasn't. At least 28 days notice must be given - it can be longer, but can NOT be shorter. The notice must end on the last day of a rental period. This means that if a 28-day non-renewal notice is given in the middle of a rental period, the end of the rental agreement may extend one period further. For example, in a month-to-month tenancy with rent due on the first of the month, if a 28-day non-renewal notice is given on Nov 15th, the rental agreement ends on Dec 31st since 28 days after Nov 15th is not the end of the month. The tenant can remain in the unit through Dec 31st, and December rent is still due. Where can I learn more about my rights on lease renewals? The New Year is almost here, and at TRC, that often means questions about ending leases and lease renewal. What's the difference between a lease and other rental agreements? Do leases automatically renew?

Part 1: Definitions Definitions to Know Rental Agreement: An oral or written contract between landlord and tenant(s). Lease: A type of rental agreement that has a definite start and end date, also known as a term. Rent is paid on a regular schedule. Periodic Tenancy: A type of rental agreement with a specific start date but no specific end date. Rent is paid periodically, most commonly month-to-month, but can be week-to-week, year-to-year, etc Term Tenant: Tenant who lives in a unit under a lease with a definite start and end date and payments on a regular basis Periodic Tenant: Tenant who lives in a unit without a valid lease and pays rent periodically, most commonly month-to-month. Tenant at Will: A tenant who lives in a unit without a valid lease and does not pay rent regularly. This type of rental agreement is called a tenancy at will. It is usually an arrangement with friends or relatives All leases are rental agreements, but not all rental agreements are leases. Part 2: Automatic renewal Do leases automatically renew? In Wisconsin, typically NO: There is no right to an automatic renewal on a lease. Unless the rental agreement contains a provision for an automatic renewal or the landlord and tenant agree to renewal, a lease ends on the last day of the agreed rental period. If renewed, the terms of the original rental agreement continue to apply to the renewed lease unless the landlord and tenant agree–verbally or in writing–about the terms that change. A written rental agreement can include an automatic renewal provision. In such cases, landlords must give tenants a written reminder of the renewal at least 15 days but not more than 30 days before the lease’s automatic renewal deadline to be enforced. Part 3: Lapsed Leases What happens if the lease ends but rent is still paid and accepted? The lease lapses and turns into a periodic tenancy. There are instances where a tenant does not receive a renewal or a nonrenewal, but they continue living in the unit after the original lease term ends. If the tenant is still paying rent on a monthly basis, and the landlord is accepting the payment, the tenancy changes to a periodic month-to-month tenancy. When this happens, the original terms of the lease still apply. The only difference is the end date stated in the original lease. Both the tenant and landlord are expected to abide by the terms of the original lease.

The Tenant Resource Center will be closed next week starting Tuesday, December 23, through Friday, January 2nd, in recognition of the winter holidays. This means we will not be staffing our UW Student Activity Center, Sunshine Place, or Saturday MATC South Campus locations these weeks, and that our main office room for those who need assistance to virtually attend Zoom court for eviction hearings will be unavailable. If you need assistance attending an eviction hearing between December 23rd and January 2nd, please visit the Dane County Courthouse in Madison at 215 South Hamilton Street. We will resume normal operating hours at 9 am on Monday, January 5th, 2026.
