The French Constitutional Council is composed of judges in their sixties through eighties, who all likely grew up with Minitel, a system for which privacy was a key constitutive feature.

It's well established in multiple jurisdictions that social media is a forum for freedom of expression. The issue is the extent of the possible limitations on this freedom.

I’m divided: we know the Tech industry will see this as a victory. I’m not criticising the judiciary. The legislation has to be watertight. Does France have the equivalent of a second house to scrutinise bills to ensure they’re constitutionally compliant?

I feel like social media constantly reminds us why courts and rule of law and their ability to proportionately sanction were such massive improvements for everyone. the mob can only venerate or destroy.
