Meanwhile, in Poland: the judicial crisis continues.

The president refused to seat a Constitutional Tribunal judge, continuing a tradition of conflict over the judiciary. The previous PiS government (2015-2023) had named over 30% of the judges in violation of norms of expertise and neutrality.

Additional reminder: Both Polish President & illegal "president" of body masquerading as 🇵🇱 constitutional court have been openly violating interim order issued by the European Court of Human Rights last May

🇵🇱 Supreme Administrative Court in 2022: “the presence of incorrectly appointed judges ... means that the whole of the Polish Constitutional Tribunal has been “infected” with illegality, and has therefore lost, in a material sense, its ability to adjudicate in accordance with the law”

Tonight Polish PM Donald Tusk has finally insisted on 5 supreme judges legally elected by the Sejm take their seats, although anti-legal PiS president Nawrocki refused to swear them in.
The EU & its courts are fully behind Tusk.
Trump prefers Nawrocki (& illegality).

Happy rewriting 😬

Any diagnosis/solution should start with the correct premise: We are not dealing with a court but a body pretending to be one and controlled by individuals in violation of Polish/EU/ECHR law

Also, 🇵🇱 (Un)Constitutional Court is no longer a court so most media coverage legally misguided as coverage reflects wrong premise that we're dealing with a lawful body when it's just a 🦘body with a long history of illegal, not to say criminal, actions since 2016
