🚨+2 Tanks yesterday puts Russia’s Tank losses just 10 away from 11,000 main battle tanks lost in Ukraine. That’s the number of tanks the USSR lost in WWII.😮

Losses of the Russian Federation in Ukraine as of July 5th, 2025 Day 1228 of Russia’s War of Aggression Against Ukraine.

this from the Ninth Circuit yesterday is just *screaming* for your invention
Our sister circuits follow similar rules. In the Fifth Circuit, courts “allow[] direct amendments to the pleadings without a remand” “[w]here jurisdiction is clear from the record.” See Seguin v. Remington Arms Co., L.L.C., 22 F.4th 492, 495 (5th Cir. 2022) (second alteration in original) (quoting Molett v. Penrod Drilling Co., 872 F.2d 1221, 1228 (5th Cir. 1989)).

5/ As the 5th Circuit put it, §1653 "addresses only incorrect statements about jurisdiction that actually exists" in the pleadings below. If, as here, there are NO such allegations in the record, §1653 is of no help.

This is long-settled law...

The parties cannot fix that problem here. True, we can allow parties to amend defective jurisdictional allegations on appeal under 28 U.S.C. § 1653. See Molett v. Penrod Drilling Co., 872 F.2d 1221, 1228 (5th Cir. 1989) (per curiam) (collecting cases). But § 1653 "addresses only incorrect statements about jurisdiction that actually exists"; it doesn't provide a mechanism for parties to remedy "defects in the jurisdictional facts themselves." Newman-Green, Inc. v. Alfonzo-Larrain, 490 U.S. 826, 831, 109 S.Ct. 2218, 104 L.Ed.2d 893 (1989). In other words, § 1653 allows us to "overlook [a party's] failure to plead diversity if [a party] can identify allegations and evidence in the record demonstrating diversity." Howery v. Allstate Ins. Co., 243 F.3d 912, 919 (5th Cir. 2001) (emphasis added). If, on the other hand, "there is no evidence of diversity on the record, we cannot find diversity jurisdiction, and we must dismiss the action for lack of jurisdiction." Id. at 920 (emphasis added).
