I left at the same time! The statement they put out was just like the one before Twitter blew up. Like we hadn’t already lived through that? No way. It was Substack’s choice to become a propoganda machine. People SHOULD leave. They are causing real harm while hiding behind the 1stAm.

The deliberate weaponization of social media, and the directly related mental health degradations, has gone beyond what’s healthy for too much of the young public.

Platforms don’t need feed algorithms or the rest to provide content. It’s not a 1stAm burden to regulate all that off.

As I contemplate teaching law in an undergrad class, it's supposed to start with 1st amendment stuff. Lolll. No actually I think the only way to make sense of this is to situate US jurisprudence in US Fascism (at least Jim Crow) Trad 1stAm framing (market logic vs. public interest) isn't gonna work.

Unfortunately the amount of 1stAm protection extended to students has never been the same as for adults. Which I realize you know, but it’s been particularly gross the last twenty-five years. When we’re willing to punish students for out-of-school speech my faith they’ll protect on-campus speech…

I assume when you said that only one violates the 1st Amendment was a suggestion that the heckler's veto is not an issue. FIRE disagrees, in the link I provided, saying "there is no First Amendment right to shout down a speaker," and not acting against the hecker's veto is a violation of the 1stAm.

For a long time people speculated whether Trump would be indicted for inciting the crowd to the Capitol, with 1stAm questions. But what he actually did was worse: he knew the violence would happen, was happening, and he tried to use it to his (illegal) advantage.

The only thing any Fairness Doctrine return could constitutionally apply tonight is over the air radio and TV. That’s it.

And even there the 1stAm severely limits what can do. Which is why the original FD required so little of radio and TV stations. It didn’t do 10% of what Bsky FD truthers think.

you're correct, but there isn't an anti-SLAPP statute in effect in Iowa, which means there's nothing for the federal court to apply, aside from a basic failure to state a claim (in a MtD) and maybe a 1stAM or state con attack on how the state claim is being used. all available in state court...

I need to find time to read this more carefully. That copyright isnt the best or even a good tool for governing various AI concerns (eg, bias) makes sense. I’m not as sure about fair use being clear cover, immutable, or driven by listeners’ 1stAm rights to the latest, fastest or best available tools
