Yesterday, #SCOTUS handed down #303Creative v. Elonis. In a 6-3 decision, the Court ruled that the First Amendment protected Ms. Smith's (the owner of 303) right not to make specialty websites conveying messages w/ which she disagrees.
The opinion is worth examining: 1/

I mean, we’re already at the point where fraudulent hypothetical cases like Dobbs and 303Creative get through (with more already in the works to tear down Obergefell and Lawrence), but sure; it’s BIDEN’S fault everything is going to hell.
This current court is gonna go down as 2nd worst in history.

When they start piling up into every aspect of modern life, when the Supreme Court makes a habit of reaching into an invalid case like 303Creative to "legislate from the bench", or there are so many laws that ignorance of the law is a very good excuse.

This is what I’ve been trying to figure out. I’ve seen references to prior restraint—is that what 303creative argued? I’m a lawyer but Con Law was definitely not my strong suit!

Following this Supreme Court case 303Creative llc vs Elenis. I don’t see how this is a contentious case. The hypothetical could be solved by one simple question. Can a gay person be Christian?
