It's aggravating that very few are talking about the 14th amendment section 3. Yes trump can be on the ballot NO he cannot hold office.

Constitutionally speaking, it’s questionable whether Trump is a legitimate POTUS therefore has immunity because A14S3 requires Congress vote to remove disqualification and that hasn’t occurred. Neither side can be legitimized without a vote.

Agree. The current or next Congress could easily pass a A14s5 bill that prohibits T from taking office (b/c he engaged in an insurrection, per A14s3.)

Aside from liklihood and Democratic guts to do it....both are highly questionable.... Is there a path to regular order by essentially invalidating Trump 2.0 on A14S3 grounds? I desperately want this.
