This means that if someone acted in self-defense to protect themselves from an assailant, they usually cannot be taken to court and sued civilly for monetary damages. These protections exist in Arizona, Arkansas, Colorado, Florida, Georgia, Idaho, Illinois, Indiana, Kentucky, Louisiana, Maryland, Michigan, Montana, New Hampshire, North Carolina, North Dakota, Oklahoma, Ohio, Pennsylvania, South Carolina, Tennessee West Virginia and Wisconsin. For example, in 2019, Indiana passed legislation that provides immunity from civil suits to people who have used justifiable force in self-defense. Conversely, in at least six states, an individual can be sued in civil court in self-defense related cases despite not being charged or convicted for acting in self-defense. Even if a person is criminally clear, a person can still be sued in civil court in Hawaii, Missouri, Nebraska, New Jersey, North Dakota, and Tennessee.
