Safe harbors are seldom a good idea; they tend to become bastardized into thievery. Just look at the safe harbor exemption to the Federal Antikickback Statute which PBMs rely on. It's a key reason Americans pay so much more for Rx's than anyone else: we pay for bribery.

The PBM industry calls them “rebates” but, in fact, they are “legally-exempted” rebate [kickbacks] which are exempted under the federal Antikickback Statute under a “safe-harbor” exemption. But whether they call the rebates or something else, they are still BRIBES.
