One of the longest serving republican internees, who has spent a totalof six years held without trial, has been prevented from making a bailapplication for over three months.

Peter Henry Mossop, 37, appeared in the ACT Magistrates Court on August 6, 2026, charged with drug driving and aggravated reckless driving. Officers reportedly found him asleep behind the wheel of a parked white Polestar on Ainslie Avenue in Reid around 1am. After being woken to check his welfare, Mossop claimed he had pulled over due to fatigue. Police later allegedly spotted the same vehicle running a red light and speeding through multiple suburbs before intercepting him on the Majura Parkway at 1:25am. Roadside drug tests indicated positive results for a prescribed drug, cannabis, and methamphetamine, leading to his arrest and an immediate 90-day licence suspension. During his bail application, Mossop repeatedly interrupted Chief Magistrate Louise Taylor and his defence lawyer, prompting the magistrate to tell him, 'just be quiet' to allow proceedings to continue. Bail was granted with conditions requiring him to reside at his Phillip address and avoid illicit drug use. The case will return to court later this month. The incident highlights ongoing issues with impaired driving and courtroom conduct, underscoring the legal consequences of such behaviour.

The Supreme Court has held that there does not exist a complete embargo on considering the anticipatory bail plea of an accused who has been declared a proclaimed offender.

Justicia Shipena  Businessman Peter Elindi’s legal team has threatened to approach the High Court if the state does not withdraw a charge related to alleged proceeds of unlawful activity by today.  Peter is one of the accused in the ongoing N$480 million Namcor corruption case. While testifying during his bail application at the Windhoek Magistrates Court on Tuesday, Peter told the court that the charge is based on mistaken identity. The state alleges that on 19 July 2020, near Windhoek, Peter knew or ought to have known that N$1.5 million paid into a Bank Windhoek account from Onyeka Clearing and Forwarding CC formed part of the proceeds of crime.  Peter said the account does not belong to him and is registered under his brother, Malakia Elindi.  “This is definitely a case of mistaken identity. It doesn’t belong to me,” he said. When asked if he knew why he was charged in connection with his brother’s account, Elindi replied, “I don’t know. It’s just a lot of confusion.” Namandje told the court he had informed state prosecutor Basson Lilongwe that the defence confirmed the account details with the bank.  He said the state was welcome to verify the information and even speak to the accused’s brother. “We expect the state to withdraw this charge not later than tomorrow,” Namandje said. If they proceed beyond that with this charge against Peter Elindi, we will file in the High Court. We will produce facts where this prosecution must be impugned and set aside by the court. It’s a mistaken identity,” Namandje said.  Peter is among nine individuals and six corporate entities charged in the case, which involves a total of 71 counts.  The charges include violations of the Anti-Corruption Act, the Prevention of Organised Crime Act, and fraud.  The state is opposing bail, citing the seriousness of the charges, possible interference in the investigation, and the likelihood of further arrests. The bail application continues today.

One of the men accused of carrying out a fatal armed robbery at the Windhoek head office of the state-owned company Namib Desert Diamonds (Namdia) in January plans to apply to be granted bail. This was said by defence lawyer Dawn Marondedze, who is representing former Namdia security officer Joel Angula, during an appearance by Angula and a co-accused, Sam Shololo, in the Windhoek Magistrate’s Court on Friday. Marondedze informed magistrate Linus Samunzala that while Angula (45) would not be applying to be granted bail at this stage, he would approach the court with a formal bail application “in the near future”. Shololo (49), who is not represented by a defence lawyer currently, informed the magistrate he has applied for state-funded legal aid and would need more time to sort out his legal representation. Angula and Shololo are charged with counts of murder, robbery with aggravating circumstances, possession of rough or uncut diamonds and attempted murder in connection with a robbery committed at the Namdia head office on 18 January. A senior protection officer of the company, Francis Eiseb (58), died when he was shot during the heist. One of the alleged robbers, Max Endjala, also died at the crime scene. The police announced at the time that he had died of a self-inflicted gunshot injury. In the charges faced by Angula and Shololo, the state is alleging that diamonds worth about N$349.3 million were stolen during the robbery. Namdia spokesperson Beverley Coussement, however, said in a media statement in March that diamonds valued at N$314.9 million were stolen during the robbery, and that diamonds worth N$40.6 million have been recovered since then. Angula has remained in custody since making his first court appearance on the charges on 21 January. Shololo, who was injured during the incident, made his first appearance in court on 28 January, and has also been held in custody since then. Public prosecutor Rowan van Wyk told the magistrate on Friday that the state is still waiting for a report on the valuation of items recovered after the heist. On a request from Van Wyk, Samunzala postponed the case to 4 August, for further investigations to be carried out in the meantime and to await the outcome of Shololo’s application for legal aid. Samunzala ordered that Angula and Shololo should stay in custody. Angula also made an appearance in the Windhoek Magistrate’s Court in Katutura on Thursday. In that matter, he is charged with counts of theft of diamonds, possession of unpolished diamonds and disguising the unlawful origin of property, which is an offence in terms of the Prevention of Organised Crime Act. The state is alleging in that case that Angula stole 13 parcels of diamonds, of which the weight and value are not stipulated, from Namdia on 18 January, and that he possessed 13 parcels of diamonds in the Khomasdal area of Windhoek on 19 January. Angula is also being held in custody on those charges, with magistrate Wilka Amalwa having postponed that matter to 21 August. Katrina Geises (50) was denied bail by the Otjiwarongo Magistrate’s Court on Monday afternoon, when she made her first court appearance in a case of attempted murder. She was arrested at Otjiwarongo in the Otjozondjupa region on Friday for allegedly stabbing her ex-boyfriend with a knife once on the left side of the chest. Magistrate Billy Lutaka informed Geises of her legal right to engage a private lawyer of her choice, defend herself in court or apply for a state-funded lawyer through the Ministry of Justice and Labour Relations’ Directorate of Legal Aid. She told the court she would apply for legal aid. Lutaka then remanded Geises in police custody, but also informed her that if she wishes to be released on bail, she should file for a bail application and bring it to court on or before 24 April for it to be heard in court. The case was then postponed to 24 April. However, public prosecutor Johannes Inongelwa strongly opposed granting bail to Geises, citing the seriousness of the matter. Geises is accused of stabbing her ex-boyfriend (32) with a knife on Friday at about 22h30 at her house in the Ombili informal settlement of Otjiwarongo. The court was told that the victim had visited Geises’ home when an argument between the two erupted and escalated into a physical fight. She then allegedly pulled out a knife and stabbed him. The injured man was taken to the Otjiwarongo State Hospital by a private security vehicle that arrived at the scene before the arrival of the police at the house. The victim was later transferred to the Katutura Intermediate Hospital in Windhoek for further treatment. Police investigations continue.
