Trial judge held federal s5(2) Controlled Drugs and Substances Act violated Charter of Rights section 7 and 15. Charter claim seems based on accused 'providing people who use [illegal] drugs with a safer alternative to the toxic illicit supply.' BCSC Justice Catherine Murray was 'proud' of accused.
BREAKING: A BC Supreme Court judge has sided with Jeremy Kalicum and Eris Nyx, who operated an illicit-drug compassion club (Drug User Liberation Front), were convicted of trafficking, and challenged the constitutionality of Canada's drug laws. Trafficking section ruled invalid, convictions stayed.
