Essayli (CDCal), Habba (DNJ), and Chatta (DNev) have been found to have been unlawfully appointed. Govt appealing.

Halligan (EDVa) & Sarcone (NDNY) pending.

Judge Schofield will hear argument 12/4 on whether US Attorney for the Northern District of NY was lawfully appointed. (Arises in Letitia James' challenge to a grand jury subpoena issued there.)

I believe he's the 5th US Atty to be disqualified for unlawful appointment. Earlier disqualifications (not necessarily in this order) were:
Alina Habba (DNJ)
Sigal Chatta (DNev)
Bilel Essayli (CDCal)
Lindsey Halligan (EDVa)

Judge Sunshine Sykes of the CDCal (L.A. area) has granted a preliminary injunction barring govt from removing an alien under the Alien Enemies Act without 14 days notice & opp to challenge. Case not filed as class action, so apparently only applies to him.

9th Circuit hears argument today on whether Sigal Chatta was lawfully appointed US Atty for Nevada. Courts have found 6 of Bondi's US Attys to be unlawfully appted: DNev, EDVa, CDCal, NDNY, DNJ, DNM. But 2 have let Bondi's appointee still run the office as "1st asst US Atty."

Judge Sykes' ruling will no longer have effect outside the Central District of Calif. That means many noncitizen detainees will be *entitled* to a bond hearing in CDCal, but the issue remains unclear everywhere else except in the Fifth Circuit, where the USCA5 accepted Trump's theory.

What's the state of play in Alien Enemies Act litigation after USCA5 punted yesterday? SCOTUS injunction still in effect for now. If lifted:
AEA removals barred in SDNY, DColo, SDTex, WDTex
Barred in CDCal, but only due to lack of notice.
Removals OK in WDPa

WELP. A few hours after the 5th Circuit panel denied SpaceX's mandamus request — and with no SpaceX filing — a Fifth Circuit judge "withh[eld] issuance of the mandate," preventing the district court judge from getting jurisdiction of the case to transfer it to CDCal again.

different places outside CDCal may differ. Here in D.Mass, the Guerrero Orellana class attorneys would say Judge Saris's declaratory judgment "says what the law is" and so a bond hearing entitlement remains here (the Gov. disagrees).
