What should be done about that, and how, is, of course, an entirely different story, but I would be extremely careful when defending a court that both the ECtHR and the CJEU found to be unlawfully staffed and lacking independence.

CJEU, immigration law/children

New case (referred to the CJEU from Dutch courts) asks to clarify EU law on expulsion of unaccompanied children - should still be relevant to interpreting the new Returns Regulation (as the law on this point has not changed) - infocuria.curia.europa.eu/tabs/documen...

Two quotes jump out at me here.
“Stonewall was not, Blake stressed, aiming to overturn the supreme court ruling. “We understand that this is the law.”

Why not? It’s bad law.

The Gist: Trans rights are Data rights
A UK court has made a decision defining genders which has put it at odds with a less noticed, more important, decision from the CJEU. This is the Gist.

1. The Polish Constitutional Tribunal is not a lawful court

The CJEU has ruled that it is not a tribunal previously established by law, owing to serious irregularities in the appointment of 3 judges and its President (C-448/23). The ECtHR (Xero Flor v Poland, 2021) and Venice Comm reached same

1. How far can you bend the rules to restore the rule of law?

2. If rulings of the CJEU and the ECtHR show serious defects in how the Court was composed, can a government take steps to restore its lawfulness?

Our Jakub Jaraczewski spent the weekend on these questions. We'll share some links below.

So dream on : the UK will not be EU member without being part of the entire Acquis communautaire, which means, inter alia, € and Schengen.

And btw, CJEU and no rebate.

The content of associate membership was unclear from the start. It must have been clear to vdL (it was to me, so come on...) that Canada would not even want full membership in the internal market as that requires EU law to apply to a very large extent. Along with, likely, CJEU. Or EFTA-Court. /2

Here's the prior CJEU case law rejecting a race-based asylum law argument as "clearly contrary to EU law", which I assume that the Commission’s lawyers will rely upon when defending the refusal to register the ECI infocuria.curia.europa.eu/tabs/documen...

December 18, 2025. CJEU: Poland's TK is not an independent and impartial tribunal. The reasons: stand-in judges and the defective appointment of Przyłębska.

Thats the part the coup framing skips. A body the ECtHR and CJEU both found unlawfully staffed and not independent isnt a court being defended, its an institution being protected from accountability. Calling the correction a coup inverts who actually threatens the rule of law here.

EU law includes the ECHR now, so as well as the CJEU cases on trans rights, this means the case law of the ECtHR is directly applicable in member states. Because of the principle of primacy of EU law lower national courts don’t have to follow superior court judgments if they’re contrary to EU Law.
