Hales alleged that Luthmann violated Florida’s sexual cyberharassment law by publishing the manipulated video online. Magistrate Judge Zachary C. Bolitho concluded the video did not meet the statute’s definition of a “sexually explicit image.” The ruling turned on the law’s specific language. Florida defines sexually explicit imagery as depicting nudity or a person engaging in actual or simulated sexual conduct. The video showed Hales’ face superimposed on another person’s clothed body, along with a woman whose movements implied oral sex. However, no genitals, breasts or buttocks were visible. Bolitho wrote that while the video was designed to suggest sexual activity, it did not explicitly depict the physical contact required under the statute. It also failed the law’s definition of simulated sexual conduct because no uncovered sexual body parts were shown.
