Not mine, but I think about this shoe-flinging accused often, and how mortified he must have been.

The incident is reported in support of the acquittal in the decision: R v Boughton, 2016 ABPC 291 (www.canlii.org/en/ab/abpc/d...).
Excerpt from the judgement R v Boughton, 2016 ABPC 291: [94] Considering the totality of the evidence, I believe the accused. He knew that the complainant did not like shoes being worn in the house. He forgot to take his shoes off after returning from the Walmart store. While slouching in a chair, in close proximity to the complainant seated on the couch, in the living room, he flung his right leg in the air in an attempt to kick his right shoe off. As a result of his physical disability, he lacked fine motor control over the right side of his body to control the force of his kick, and kicked the complainant in the ear on the left side of her head. [95] The accused did not mean to kick the complainant in the head, nor was it objectively foreseeable. He did not intend or threaten to apply force to the complainant. He lacked the requisite mens rea so as to constitute the offence of assault. The Crown has not satisfied me beyond a reasonable doubt that what the accused did, with the resulting injury to the complainant’s ear, was not an accident. [96] I am fortified in my conclusion by the demonstration in open Court on cross-examination of the accused by Crown Counsel. When the accused flung his right foot up, at the request of Crown Counsel, with such force that his shoe went flying up over the bench, narrowly missing me, and landing in the waste basket beside my chair, I am sure that he didn’t mean to hit me, or threaten to hit me, and that what happened was an accident.
