Vineland Data Center Gets a Notice of Intent to Sue Over Gas Generators. No Lawsuit Has Been Filed.
On Oct. 21, the community group Sustain SJ, represented by Earthjustice, sent a notice of intent to sue over DataOne, the AI data center being built in Vineland. The notice alleges that 62 natural gas generators at the site operate without required federal Clean Air Act permits and that the facility lacks required emissions controls. It names four companies, among them DataOne Vineland, Nebius Inc. and Northeast Precast. A notice is not a lawsuit, and none has been filed. The group says it intends to sue in federal court if the violations aren't addressed after the notice period ends.
The notice is separate from the $1.07 million fine the state Department of Environmental Protection issued under state law, which the governor's office announced Sept. 22. DataOne did not immediately respond to WHYY about the notice. A DataOne spokesperson said last month, per WHYY, that the engines are a temporary measure until Bloom Energy fuel cells are running.
