Description: A due process hearing before an impartial Hearing Officer is one option to address conflicts that may arise between parents and school districts in special education. Because it is a formal, legally binding, and time-consuming process, it is essential to understand when and why a due process hearing is the right option. Participants will gain a practical understanding of due process from a panel that includes an experienced special education Impartial Hearing Officer, student/parent attorney, and a school attorney. Learning Objectives: What is a due process hearing; what types of disputes can due process hearings resolve; what types of remedies are available through due process hearings; important considerations when deciding to use a due process hearing; overview of due process procedures and requirements, including the resolution process; whether parents should consider legal representation; overview of alternatives to due process hearings to resolve special education disputes. Presenters: Jean Lucasey, Impartial Hearing Officer; Tara Moffett, Esq., Girvin & Ferlazzo, P.C.; and Julie Keegan, Disability Rights New York. Register here.
