One thing is that, as far as housing goes, the ADA only applies to public housing, as defined, and the FHAct Amendments only to multifamily buildings originally built after ‘91, so a privately funded ADU isn’t subject to either, unless there are enough units there to trigger FHAct requirements.

Some states, like where I am in California, build the ADA and FHAct requirements into their State Building Code. Then it varies by funding source. Sometimes, there are special reqs for certain resident populations, like Seniors in California funded by LIHTC.

But since this looks like an existing old building, the FHAct wouldn’t apply anyway if the building were built for first occupancy (for any use) before March 13, 1991.

One thing here is that the LADBS doesn’t enforce the FHAct amendments, but rather the California Building Code. If a building was built for first occupancy after 3/13/91, and it has 4 or more condominium units, or 3 or more rental units, the ground floor units must be adaptable.

Yes, accessibility for people with mobility impairments becomes more difficult with multistory units. Sometimes you’ll see developers build townhouse-style units specifically to avoid adaptability requirements. The provisions of the FHAct Amendments are often seen as onerous (but shouldn’t be).

The ADA covers very little housing. Only if it meets the definition of “public housing” (which doesn’t need to be publicly owned, just receive public subsidy). The FHAct Amendments cover privately funded apartments of 3+ units. Neither requires an elevator. But I’m so glad they both exist.

I’ve been wanting to go to a library and peruse the old ones to see when some things like that appeared. I did that one time for building code accessibility standards in CA from the period just before the ADA and FHAct Amendments came into force.

Although, yes, I know the AFFH clause of the FHAct only applies to agencies of the federal government that touch housing, like HUD, USDA, etc. but the stand-alone AFFH law here in California offers a clearer path to statewide zoning abolition, since it applies to many more entities. 2/
