The adviser here was Strauss Phillips & Co - a firm of chartered accountants regulated by the ICAEW.

As seems typical in these cases, the original offence (using AI incompetently) was compounded by the firm deceiving the Tribunal

I hope the ICAEW takes action.

I mean - you can't just levy massive fines and say it's "to send a message to the rest of the industry"! That's not how regulation works!

Axiom Ince’s accountants were Adrian C Mansbridge & Co.

Their website has fallen through a time-warp from 2005 but this is a real firm of chartered accountants and registered auditors, regulated by the ICAEW and ACCA.

No surprise to many Chartered Accountants who have to submit annual Fit and Proper compliance forms to ICAEW. Meanwhile firms of unregulated Accountants have flourished thanks to advances in IT. Many are decent, but proper regulation would stop the rogue element.

Worse, the ICAEW report was anonymised. It looks like the firm was guilty of no more than a minor technical breach. Nobody knew it was a critical element to the £64m Axiom Ince failure.

So it's a double regulatory failure.

The SRA missed a chance to protect the public and the solicitors' profession.

The ICAEW missed a chance to protect the public from an incompetent accountant, and inform stakeholders of a key element in Axiom Ince's failure.

There are several different accountancy bodies in the UK. ICAS in Scotland is the oldest one, dating back to 1854. ICAEW was founded in 1880, with ACCA coming along in 1904.

If you follow the chain of authority on what constitutes "accumulated, realised profits", you go via the recognised accounting standards to ICAEW Technical Release 02/17BL (This is referred to in the accounting standards, and there is a statutory instrument making them the accounting standards)

In particular I’d note in passing that (at least in my day) ICAEW exams showed significantly higher pass rates for, say, Maths and English grads than for Accountancy grads… 3/4

A very clever and accomplished friend joined one of those big firms in the early 80's. Qualified and thus chartered he was told he had no partnership prospects because of the colour of his skin. Left, set up businesses, made millions. Still a fellow of the ICAEW as it opens doors but..

Just renewed my ICAEW membership for the year. Only the reduced £60 fee, though, now I'm on a 'career break'. Need to make a clean break away, but I'm too nervous not to have the comfort blanket of a solid career if this change goes tits up. I need more confidence in myself and my decisions.

I was at an audit event with an AI panel, and after they banged on I asked one question that ruined it for the ICAEW guy:

"how does this fit in with your ESG, & do you think AI use can be reconciled with environmental responsibility given we're 7 years into a government declared climate emergency"
