I always show my students this clip in crim pro. It's actually a remarkably accurate account of just how Dirty Harry violated the Constitution, complete with case citations. And the district attorney and the judge are the bad guys for pointing it out. www.youtube.com/watch?v=kh62...

It's worse. He's writing as if the 4A DOESN'T protect people who have done nothing illegal. He's writing as if the 4th amendment is ONLY there to coddle criminals, hence the balance of equities should always tip the other way. This is "Dirty Harry"-level analysis. www.youtube.com/watch?v=kh62...

There needs to be some way of conveying how absurd Kavanaugh's concurrence is. Calling it a 'Callahan Stop' to emphasise his thinking is just that scene from "Dirty Harry" would backfire. People would think it was some tough guy joke, when it is just - what it is. www.youtube.com/watch?v=kh62...
