Neither of these exceptions is rooted in the law. If they were, the rule against sex discrimination would be toothless. Sutton’s equal-application principle borrows an idea from the days of Jim Crow, when segregationists claimed that race laws—like the ban on interracial marriage—were not discriminatory because they treated the races equally: White people couldn’t marry Black people, and Black people couldn’t marry white people. The Supreme Court rejected this sophistry, holding that any classifications on the basis of race are subject to heightened scrutiny. And it has rejected this theory when applied to men and women as well, ruling that any classification on the basis of sex triggers heightened scrutiny, even if it theoretically affects men and women equally.

On Monday, Donald Trump's Department of Justice made two arguments in two different courts that, taken together, amount to a legal claim of near-dictatorial power by Trump. First, it informed a federal appeals court that the president has authority to declare any noncitizens to be "alien enemies" and to deport them to foreign prison, where they will be forced to perform hard labor indefinitely-without notice, a hearing, or any meaningful opportunity to prove their innocence. Second, it refused to provide U.S. District Judge James Boasberg with details of these mass deportation operations, even in a closed courtroom, even under seal, insisting that Boasberg's authority must yield to the "mandate of the electorate." In other words, Trump's electoral victory grants him an absolute right to conduct these deportations, rendering them unreviewable by the judiciary.

Out of court. Fascinating to see Judge Xinis in action. My read is that she’s FAST losing patience with the defendants, and skeptical that they will comply with her orders in “good faith” (a phrase she used many times, pointedly).

For those asking why the liberal justices didn't step in here: I think they are VERY hesitant to expand the scope of the Religious Freedom Restoration Act after the conservative justices badly abused it in Hobby Lobby. I'm not justifying their votes, but I suspect that was the overriding concern.
