#Materiality
Safer discusses materiality of this alleged false statement regarding NY Post story about the laptop.

Safer: What possible materiality could there be as to whether he remembered a NY post story?? Nothing more needs to be said on that.

Kirkpatrick moves to materiality in para 56 of the affidavit. Argues that someone who "oversaw" investigation in the majority is sufficient to speak to materiality question....minority wouldn't be in position to take action on behalf of committee.

- Agent lack of understanding of materiality element important as well. Didn't know political makeup of committee...

First, Safer addresses materiality.

He says materiality in affidavit depends entirely on Castor. He's unreliable for 2 reasons: (1) Political appointee, (2) This is a politically charged investigation. Zero possibility that that man gives the "wrong answer" -- there's a reason they went to him

MJ: Did you have to have *any* info from the committee to determine materiality? We had disclosure that Davis said need someone who was in Benavides testimony...Can someone who was not there answer materiality?

Jacobs: Yes, as long as person authorized to speak on behalf of body...

Hard to say given SCOTUS precedent on materiality

Would likely have to be something like "modernizing election equipment" or some shit

Kirkpatrick: The defense is making a mountain out of molehill on materiality. Fair to say man who oversaw the investigation knew what was going, what was material....

A lot of the materiality points go to the truth points, so will start with that and respond to some of those.

Dohrmann addresses materiality. On this element, her slide says that the government must explain *how* the statement could affect a *specific* decision or function of the committee.

Me picturing Cory Jacobd reading case law to an MJ defining materiality

I think it's objectively bad that her campaign did that and I wish they hadn't and think the NYT was absolutely correct to report on it. All that being said, I think it has been covered out of proportion to its relative materiality.

These four visual compositions explore the conceptual and aesthetic tension between the human body and artificial materiality. Each one shows limbs or skin folds (such as arms or joints) constrained, wrapped, or fused with contrasting textured elements.

Which, honestly is a hangover from colonial reactions to the materiality of other ontologies. But hey. We don't talk about that.

That is absurd, and is at odds with the foundational definition of materiality.

Kirkpatrick: As to materiality, clear it was important, this was big news, FITF had role in election intelligence/counterintel....Senators made statements about it

MJ: But the only evidence I have is what Castor says. That's all I'm considering...

instead it's much more organic- you are constantly learning specific movement tricks, route planning, being a scientist. because tool use works this way, it is synergistic with the way the game draws you into trusting the materiality of the world, enjoying details: the methodical, deepening spiral.

Now Cory Jacobs makes his way to the lectern to address some case law for DOJ.

He cites standard for "materiality": Statement has to have "natural tendency" or be "capable" of influencing decision-making body...

Safer is on to this. Says that this is the one statement Benavides did get wrong -- he misremembered. But this statement was not given to or described to Castor, who is sole witness on materiality...And how could "discussions" be material, anyway?
October 29, 2026 at 7:34 PM
MJ: Bc I don't think an FBI agent could speak to materiality...I just wanted opportunity to say out loud what I'm thinking,...but general counsel is different story, and as I understand it he was there for Floris testimony...
October 29, 2026 at 9:03 PM
It had several lies, some dealing with materiality (which will help Benavides more than Floris), and some dealing with provenance of laptop which, thus far, has not been touched.

Donovan asks about materiality. She asks about the "committee staffer" referred to in the affidavit. That's Steve Castor?

Witt: Yes

Donovan: Did you approach any Democrats on the Committee?

Witt: Absolutely not
October 28, 2026 at 6:44 PM
Donovan: But do you understand that democrats have their own general counsel for the committee?

Witt: I just wanted someone who was authorized to talk on behalf of the committee about materiality
October 28, 2026 at 8:28 PM
Castor also unreliable on substantive grounds. Agent said you would want someone -- need someone -- to judge materiality based on entirety of testimony.

But in fact he wasn't at Benavides testimony. He didn't even read it. And yet he's one who says that testimony affected investigation....
October 29, 2026 at 7:05 PM
Safer now pivots from materiality to his second major argument: that the testimony was accurate.

First, he says, there's no evidence in the affidavit that he was actually familiar with the NY post article. Zero. And then he goes on to say he was aware of a laptop narrative.
October 29, 2026 at 7:37 PM
Safer: And during this call it was mentioned that Castor was part of the "HJC majority" on the committee

Witt: Yes...but Witt says he didn't catch it, reiterates he wasn't focused on partisanship...says he was told Castor was only one who was authorized to speak on materiality
