This was an incredible concession that Judge Howell extracted from Mizelle.
Howell says she finds the gov't's argument "chilling."

Mizelle says this is within the president's "sole authority" re: national security.

Williams & Connolly "could be next," Howell suggests.

Such an order could follow, Mizelle eventually agrees, w the caveat if there's a nat sec finding.

Mizelle was disgraceful. Essentially gaslighting the court. Judge Howell was trying not to openly laugh at some of the assertions he was making.

She skillfully and effortlessly carved Mizelle up like a Thanksgiving turkey.

I think I’d like to start a Beryl Howell fan club.
Mizelle suggests Perkins Coie could be losing clients because Republicans won the White House, not because of the executive order THREATENING TO BAR PERKINS COIE FROM FEDERAL BUILDINGS.

4 years ago, Trump Judge Kathryn Mizelle vacated Biden’s airplane mask mandate:

Now, Trump Judge Kathryn Mizelle says vacating rules is likely unconstitutional:

I wonder what changed!

Mizelle isn’t even working for DOJ anymore!
DM me? We used to get hundreds of highly qualified applicants for a single job posting. Good prosecutors are increasingly hesitant to work for this DOJ.

Chad Mizelle is such a chad.

Chad Mizelle is married to Kathryn Kimball Mizelle, the Trump judge who unilaterally lifted the CDC’s mask mandate for airplanes and public transportation while Omicron was spreading like wildfire.
This rules so hard. In law school I remember people who wanted to be federal prosecutors spending three years doing everything they could to be maybe, possibly be competitive for an AUSA job someday. Now you just need to hop on X the everything app and DM a guy named Chad.

Perkins Coie's lawyer says that Mizelle was not describing a Constitution he knows.

Judge Howell presses DOJ chief of staff Chad Mizelle on whether Williams & Connelly could be next with Trump's unreviewable power.

"Your answer would be yes?"

Mizelle answers that the president has "sole authority."

Because I raised questions about any confusion of Chad Mizelle showing up in the Perkins Coie hearing yesterday, here's how that went down.

At #FedSoc, just-departed Bondi chief of staff and acting DOJ No. 3 Chad Mizelle urges Congress to step up campaign to impeach federal judges who've blocked Trump policies. Mizelle also rejects Roberts' stance that rulings can't be grounds for impeachment. www.politico.com/newsletters/...

"The American Bar Association (ABA)'s Standing Committee on the Federal Judiciary [...] rated Mizelle "Not Qualified" to serve as a federal trial court judge, noting that "Since her admission to the bar Ms. Mizelle has not tried a case, civil or criminal, as lead or co-counsel."

"That is the President's prerogative under the Constitution of the United States."

Bondi's former chief of staff Chad Mizelle: "Part of the reason the weaponization work has been difficult is that you need people who are MAGA and who are really competent."

Mizelle insists that this is all speculative, but Howell says, essentially, "Hold on."

Mizelle says there's a traceability because people pick lawyers for lots of reasons — i.e., the EO might not be the reason that Perkins Coie is losing any clients.
March 12, 2025 at 7:01 PM
Reminder: It’s really not normal for a senior DOJ official to publicly confirm that DOJ is getting ready to indict someone!

(Not to mention that Mizelle no longer works at DOJ — how exactly does he know “of what he speaks”?)
November 23, 2025 at 8:49 PM
The obvious reason, of course, is likely that even Chad Mizelle realizes these are big losers of dramatic unconstitutionality.

And yet!

Shocking that Ensign — and not Mizelle or Blanche — signed his name to this. He’s all in.
DOJ goes to the D.C. Circuit, essentially saying Chief Judge Boasberg acted improperly by … asking questions about whether they followed a court order. This is wildly uncalled for and should be immediately rejected. storage.courtlistener.com/recap/gov.us...

And it sounds like Mizelle knows it.

Mizelle says "national security" provides sufficient basis for Section 1, 3, and 5 of the EO.
March 12, 2025 at 6:47 PM
Howell: "How is this not all viewpoint-related purposes for this order?"

Mizelle goes to the Steele dossier.

Howell: "Let's not get into a debate on that."

Mizelle says the issue whether it's reasonable for the president to decide whether someone is "not trustworthy with our nation's secrets."
