Smith is not making the claim a jury would have convicted. He is restating the standard prosecutors must meet before they can indict, that he believed there was sufficient evidence to obtain & sustain a conviction. The decision is left up to the jury. Justice is done when they have that opportunity.

This morning, #NBCTodayShow got it right, pointing out that the funding bill that Trump approved FAILED because 38 Republicans voted no and running the viral clip of a Dem on the floor pointing out it failed "because you can't agree amongst yourselves." Maybe not everyone wants to be Trump's friend?
