A lot of bloviating about political optics with only the thinnest gloss of trying to explain how any of this means NVRA lets them sue over anything vaguely affecting "the integrity of the electoral process" even when no specific, operative provision of that law has anything to do with any of this.
DOJ has filed their opposition to the motions to dismiss, and, well. storage.courtlistener.com/recap/gov.us...

It'd still be frivolous but they would have come closer to a colorable claim that this is some nebulous 14A violation. Absurd, but at least then you're in the realm of broad generalities with complicated ways to apply them. NVRA just straight-up isn't a law about candidates appearing on the ballot.

• Voter Registration Lists: Under Section 8 of the National Voter Registration Act of 1993 (NVRA), states must maintain all records concerning voter registration lists and list maintenance activities for at least 2 years.

No role for DHS either, despite what the plumber from Oklahoma claims.

Conspiracy crap is irrelevant, and the purpose intro to NVRA can’t be used as a cause of action. Lots of rhetoric but legal BS.

"The U.S. Supreme Court recently agreed to hear Republican arguments in an Arizona case that could severely weaken the 90-day “quiet period” of the National Voter Registration Act (NVRA) — a safeguard meant to stop states from conducting mass voter removals too close to a federal election."
Explainer: Federal law that protects voters from last-minute removal is at the center of Trump’s anti-voting war
If the Supreme Court weakens the quiet period, that protection could be replaced by a dangerous rule under which last-minute purges are barred only when states call them purges.

Am I the only one who finds it ironic that Attorney General Blanche is basing this litigation on the National Voter Registration Act Of 1993 (NVRA) while the Trump administration is working to repeal every part of that law?

The federal government needn’t helplessly stand by when States act to frustrate federal elections.

- Judge Patrick Bumatay

Chris, is it daft to point out the Election Clause and the NVRA
vest control over the federal elections in other actors, leaving no role for executive branch?

The law Trump is relying on is the "National Voter Registration Act (NVRA)" that permitted voter registration by state motor vehicle agencies. There is nothing in the NVRA that addresses ballot access. Further, the DOJ framing is designed for the GOP majority on the Supreme Court on emergency appeal
October 25, 2026 at 1:35 PM
The play here is to get SCOTUS to agree to an absurdly broad interpretation of federal NVRA law so that can be used to tie up state certifications all across the country.
October 25, 2026 at 3:57 PM
And there's also a Supreme Court case coming up in December (RNC v. Mi Familia Vota) that affects Arizona as well as other states regarding the NVRA.

Caller alleges registrar neglect and threatens DOJ complaint over voter-roll maintenance

The 1993 NVRA contains no mention of candidates. The only argument the NVRA gives the DOJ would be that 12.2.b applies, and they’d have to show the cast ballots THEMSELVES would be “materially false, fictitious, or fraudulent” under State law. The Alaskan Supreme Court has ruled…

There is no possible way to read the either the NVRA or Bullock to conclude there is a federal interest in excluding a “frivolous” candidate that the *state Supreme Court* has concluded is legitimate

The Federal law that Blanche refers to is the NVRA which has nothing to do with the Alaska situation www.nytimes.com/2026/10/23/u...
Why Legal Experts See the Justice Dept.’s Alaska Election Challenge as Dubious (Gift Article)
No obvious legal authority supports a pre-emptive effort to block the certification of Alaska’s Senate election if the Republican incumbent narrowly loses.

Evaluating the statutory mechanism referenced by @democracydocket.com: DOJ relies on a Section 8 NVRA purge petition, yet Exhibit B shows the underlying match algorithm used a loose 3-field phonetic token match, which GAO-23-104928 previously audited at a 22.4% error rate.
UPDATE: Republicans are supporting the "reasonableness" of the DOJ's legal effort to force California to set aside mail ballots from 20k voters it alleges are noncitizens.

The filing comes hours before a judge will hear arguments on the DOJ's request to force the state to set aside the ballots.

But actually the NVRA to “protect the integrity of the voting process“
*bitter laughter*
October 23, 2026 at 4:38 PM
I love how they claim a cause of action here under the NVRA, which has literally nothing to do with candidate selection or "voter confusion" and is purely about voter registration.

Bash mentions the Motor Voter Law, nickname for the National Voter Registration Act (NVRA) which enables any American to register to vote when they get their state drivers license, among other things
