Once again it is the very absence of decent data that presents opportunistic lying #GenderCritical's to make stuff up, especially so with a pliant media that needn't be arsed about "journalistic rigour". These figures were quoted in and around the #WestminsterHalls debate of 12th January 2022.
Transgender Prisoners Volume 706: debated on Wednesday 12th January 2022 Tim Loughton > (East Worthing and Shoreham) (Con) 3. What the Government's policy is on placing transgender women with sexual abuse convictions in female prisons. (Unique identification number 905017) The Parliamentary Under-Secretary of State for Justice > (James Cartlidge) Transgender women can be allocated to women's prisons only following a rigorous risk assessment, with particular consideration given to the type of offence they have committed and the risk that they pose to others. The result is that well over 90% of transgender women in prison are held in the men's estate, and there have been no assaults or sexual assaults carried out by transgender women in the women's estate since we strengthened our approach in 2019. Just to emphasise, there is an exemption to the Equality Act 2010 requirement not to discriminate against transgender people in relation to single-sex spaces where doing so is a proportionate means of achieving a legitimate aim. Prisons can and do rely on that exemption. 2. Transgender Prisoners There were 230 transgender prisoners in the 2022 data collection This was increase on the figure of 197 recorded in 2021. Most reported their legal gender as male 187 prisoners reported their legal gender as male, 43 as female. There were 21 transgender prisoners from an ethnic minority background Where ethnicity was known, 10% of the transgender prison population were from an Ethnic Minority background, this is a decrease from 11% in 2021. There were an additional 11 prisoners known to have a Gender Recognition Certificate This is up from 10 on 31st March 2021. Most transgender prisoners were in the men's estates 181 transgender prisoners were in male estates and 49 were in female estates. There were 6 transgender women in female establishments. Out of the 181 MTF prisoners, only 6 are in female prisons. Self-ID scare tactics are false. JK Rowling is a liar. #NoToSelfID The gender reform legislation does not affect any NHS clinical decision-making process about minimum age and other criteria for approving a trans person receiving any medical interventions, including hormone blockers, cross-sex hormones or any surgeries. Those criteria are based on international clinical best practice and are set out, at least from a Scottish perspective-the Minister might want to look them up-in the NHS Scotland gender reassignment protocol. Decisions are taken by doctors together with the person based on clinical judgment. Gender recognition reform does not affect the criminal justice system, at least from my perspective. As I think the Minister will agree, the placement and management of trans people in custody is based on careful risk-assessed decision making. A gender recognition certificate does not give a prisoner the right to move to accommodation for the other sex. Provision will continue to exist for prisoners who are legally female, whether trans or not, to be held in the male estate if necessary for the safety of other prisoners or for their own safety. I see the Minister nodding their head. Not do I believe that gender recognition affects women's rights or trans people's rights under the Equality Act. The Act sets out when services can lawfully be single-sex only. I think we have heard that point put forward and argued on both sides of the debate. The Act also states that the general rule is that trans people should be allowed to access the single-sex services matching the gender they live in, except that they can be treated differently where that is a proportionate means to a legitimate aim, or excluded in exceptional circumstances. Whether or not the trans person has gender recognition is not part of the rule. None of this will change.
