WARNING NOTICE YOU MAY BE IN VIOLATION OF FEDERAL LAW U.S. Immigration and Customs Enforcement (ICE), Office of Professional Responsibility (OPR) is responsible for protecting ICE, its employees, and its facilities against internal and external threats. OPR is responsible for enforcing crimes against the United States as authorized under Title 19 of the U.S. Code and as designated by the Secretary of Homeland Security, including criminal investigations into threats made against ICE personnel. OPR has identified an email sent to Acting ICE Director Todd Lyons, which it has reason to believe may constitute a violation of Title 18 of the U.S. Code. Accordingly, OPR is requesting that you promptly remove and/or discontinue the aforementioned behavior. This Notice officially informs you that it is unlawful to threaten to assault, kidnap, and/or murder a federal official or that federal official’s immediate family member with the intent to impede, intimidate, and/or interfere with the federal official’s duties or retaliate against a federal official due to the performance of their duties. 18 U.S.C. § 115(a). You are further advised that knowingly making restricted personal information about a covered person, or their immediate family member, publicly available with the intent to threaten, intimidate, or incite the commission of a crime of violence against that person; or with the intent and knowledge that the restricted personal information will be used to threaten, or intimidate, or facilitate the commission of a crime of violence against that person violates federal law. 18 U.S.C. § 119. WOW. Rep. @jayapal.house.gov says CBP's internal affairs department found that a Chinese woman who had overstayed a visa was arrested by Border Patrol and hung herself in a cell. She wasn't found for two hours—even though the records reported multiple welfare checks (suggesting records falsified?).
According to CBP OPR, the woman was taken into custody in California after it was determined that she had overstayed a B1/B2 visitor visa. Agents transferred her to Arizona where she was detained. According to information provided by CBP, logs note that multiple welfare checks were conducted, however, CBP OPR was unable to verify if those checks actually occurred, and for some of them, a Border Patrol Processing Coordinator (BPPC) stated that he did not conduct the logged checks. Surveillance footage showed the woman create a noose and tie it around her neck, yet no medical response occurred for nearly two hours.

That is because OPR—not the United States Attorney or the U.S. Attorney’s Office (which might in the ordinary course be perceived as partial)—is the longstanding independent entity in charge of investigating “allegations of misconduct” involving Department attorneys. 28 C.F.R. § 45.12; Justice Manual §§ 1-4.200, et. seq.; 28 C.F.R. § 0.39(c)(c) (heads of offices “shall provide information and assistance” to OPR in connection with its inquiries). If OPR determines that there was actionable misconduct after conducting its investigation, OPR will make a professional misconduct finding that triggers various effects. DEFANGED ETHICS WATCHDOG Department policy requires attorneys to report any judicial finding or substantial allegation of misconduct to the OPR. Its investigations, if ​sustained by DOJ leadership, can lead to attorneys being fired or referred to state disciplinary authorities for review of their law licenses. Since Trump returned to office, the Office of Professional Responsibility has shrunk from 29 employees to 16, according to Justice Department data Reuters obtained through a public-records request. The administration also ​fired OPR’s director, Jeffrey Ragsdale, and has yet to name a replacement. Such office turmoil “sends a message to the workforce that ethics is not important or that ethics is subordinate to the wills or interests of the political administration,” said Benjamin Grimes, a former Justice Department ethics official who now lectures at Columbia Law School. During the 2025 fiscal year, which ended in September, OPR opened seven new investigations, the lowest in two decades, even as the office received 1,666 complaints, the highest in any year since 2005, according to a Reuters review of annual reports. The office has not disclosed its more recent work this fiscal year. By comparison, the office opened an average of more than 18 investigations annually during ​the past decade, including Trump’s first term.
