15% UAE Minimum Tax: Time to Move to Greener Pastures? For years, the UAE’s tax story was simple: Low tax. Free zones. Business-friendly. Close to India. Now, the conversation is getting more complicated. The UAE’s Domestic Minimum Top-up Tax (DMTT) applies from financial years beginning on or after 1 January 2025. It targets multinational groups with consolidated revenue of €750 million or more in at least two of the previous four years, bringing their UAE effective tax rate up to a 15% minimum, where applicable. So, should Indian businesses start looking for greener pastures? A UAE-only group, for example, isn't an MNE group merely because it is large. The rules are aimed at qualifying multinational structures & the calculation involves much more than simply comparing the UAE's 9% headline corporate tax rate with 15%. And this is where I think businesses need to change their mindset. The question is no longer: “Where is the lowest tax rate?” It is: “Where is the most efficient structure for our entire business?” That means looking at: Group structure Effective tax rate Free-zone status Economic substance Cross-border transactions Transfer pricing Accounting data Compliance requirements The interaction between UAE and Indian tax positions That's the important shift. And there is a deadline worth watching. So my takeaway? Don't relocate because of a headline. Map first. Understand your group. Understand your substance. Model the effective tax rate. Then decide. Sometimes the greener pasture isn't another jurisdiction. It's a better structure in the one you're already in.
