Amy Coney Barrett suggests that the health care ban might not be sex discrimination under the 14th Amendment because its "burdens of the law fall equally on boys and girls because neither can transition." She asks if it should be seen more as targeted discrimination against transgender people.

especially re: 2, one must ask, in what way is this court majority actually opposed to Plessy v. Ferguson?
This will not end w/ voting rights. The fundamental premises of these SCOTUS opinions are:
1) Anti-discrimination is actually unconstitutional discrimination;
2) Intentional discrimination isn't actionable if any alternative rationale is presented.
It's the beginning of the end of civil rights law.
This heinous ruling confirms a worst-case-scenario reading of Callais as an all-purpose shield for racist lawmakers who want to gerrymander Black communities into electoral oblivion. And it’s outrageously partisan—a totally unprincipled gift to the GOP.

every time I read this, I get apocalyptically apoplectic about how clear it is. it is instant. it does not require explicit congressional action to invoke, it instead only requires that to remove.

i think this is right and i will observe that this is essentially the position the court took in plessy v. ferguson, which held that the constitution has no bearing on inequalities of social power
There is a stance I will call "Kavanaugh neutrality" that says the Constitution is "neutral" between vulnerable people and the power of the state and so we will watch and shrug while the vulnerable are beaten up in our presence. #Skrmetti

It pretends partisan gerrymandering is a reasonable, race- neutral prerogative of the state, the same justification Plessy used for Jim Crow

really can't be said enough that this case was decided by the same court that decided plessy v. ferguson. if they could have found a plausible rationale to limit birthright citizenship they would have done it. but there is none! the text is as clear as constitutional language can be.

What's happening in Minnesota is one reason the Reconstruction Amendments banned insurrectionists from holding office. Unfortunately, the originalists on the Supreme Court interpreted the plain language of the amendment to mean its opposite.

the position of the roberts court is both that racism isn’t real and that the constitution mandates a colorblindness so strict that it neither recognizes nor can act on social inequalities. incidentally, this is essentially the court’s holding in plessy v. ferguson.
