yeah basically nader's political program was that governmental action should be driven by compulsory or prohibitory lawsuits by activist nonprofits in front of unelected judges rather than via politics as more conventionally understood

Vladimir Komarov seems to support an ACTUAL temperance movement not…whatever they’re doing now. And wisely points out: “Prohibitory measures, however, cause nothing but irritation among citizens.”

I agree

Every Democratic member of the Senate Finance Committee needs to call, send a letter to, talk personally to Treasury Secretary Bessent about their outrage that Elon Musk has access to our treasury payment system. Musk must be denied access. File a prohibitory injunction today denying his access.

(For the nonlawyers:
A prohibitory injunction is the court telling you to stop doing something, or to not do something. A mandatory injunction is the court telling you to do something.

I remember researching the issue a couple years ago, and I'm pretty sure mandatory injunctions are less favored.)

A Budweiser advertisement from August 1914, praising O'Connell as a "Lover of Liberty" who "was opposed to any Prohibitory legislation which invaded the Natural Rights of Man" and who "knew there is no evil in the barley brews and light wines of their Fathers". 🗃️

“They Managed a Protest: Prohibitory, Ethical, and Prudential Policing of Academic Speech” was just published in the BYU Law Review!

Events have, er, transpired since the article was drafted but it’s still very relevant for folks actually trying to regulate (as opposed to crush) campus speech.

AL asks for immediate relief, including issuing a brief order with reasoning to follow.

DJC: 1Q. Footnote: p.9 n. 10, prohibitory PI not a mandatory PI. I wonder why you thought the distiction significant?
AL: We can prevail under any standard, that's why it's a footnote.

My latest draft--"They Managed a Protest: Prohibitory, Ethical, and Prudential Policing of Academic Speech"--is up on SSRN. It offers a fresh look at recent campus protest/free speech incidents and the competing, often contradictory expectations we have for campus admins policing such incidents.
