I think it was very important to the Walt Disney family of entertainment properties to include everyone from the 2000 XMen movie so while he probably could have turned it down I think they made it very easy to say yes and very minimal work.

I know what staff mean, but they are wrong. The city does have jurisdiction over the CAP. They can change the LUBs to allow developments that don't qualify for the CAP. Keeping LUBs that only allow CAP'd properties to be built is a council decision to keep the CAP in place.
