The Purcell Principle means it always too late for courts to fix something racist and never too late for states to do something racist
This is absolutely outrageous. SCOTUS reinstated Texas gerrymander 15 weeks before primary because they claimed it was too close to election to block it but now allowing Alabama to gerrymander one week before primary after trial court found map was intentionally discriminatory against Black voters
#BREAKING: Over dissents from the three Democratic appointees, #SCOTUS issues “GVRs” in the Alabama cases—vacating district court injunctions & remanding for further proceedings in light of Callais.

In practice, this means Alabama can now redraw its congressional districts in time for the midterms:

Purcell doesn't apply to Republicans
Watching all these GOP-controlled states race each other to gerrymander their districts before the 2026 midterms, it is hard for me to look at the timing of Callais and not conclude that the conservative justices decided the case on the earlier side to do their fellow Republicans a favor

The Purcell principle was always a legal fiction applied selectively. But we are now beyond mere inconsistency. The Court has used the Purcell principle to erode any trust that there is any principle at all.

SCOTUS decided Purcell, which requires election law challenges to be resolved with enough time for implementation and now they are slow-walking cases that would be timely under Purcell so those cases have no effect either. Wonderful!

Purcell for thee but not for me
In Louisiana and likely Alabama, actual, cast votes are going to be tossed out as officials speed ahead with new (or previously enjoined) maps.

This is such an extreme use case for the Purcell principle that the court ignoring it here signifies that it was always a made-up toy, not law.
Sotomayor: "Alabama’s congressional primary election is next week, and vacating the District Court’s injunction will immediately replace the current map with Alabama’s 2023 Redistricting Plan until the District Court acts, even though voting has already begun."
