The chances of Lembaga Tabung Haji (TH) recovering the entire outstanding 899 million Saudi riyal (1 Saudi riyal=RM1.09) arbitration award from Al-Rawda Real Estates Development & Project Management Co Ltd are slim, said an expert.

KUALA LUMPUR: Lembaga Tabung Haji (TH) is continuing efforts to recover an outstanding arbitration award of 899 million Saudi riyals from Saudi Arabia-based property developer and management firm Al-Rawda Real Estates Development & Project Management Co Ltd, including through asset tracing. Minister in the Prime Minister's Department (Religious Affairs) Dr Zulkifli Hasan said TH had taken various enforcement measures after an arbitration award in its favour ordered Al-Rawda to pay the amount. However, Al-Rawda was subsequently found to have no financial capacity to settle the award. "TH has taken all enforcement measures against Al-Rawda. However, Al-Rawda was found to have no financial capacity to pay the amount," he said during a special sitting of the Dewan Rakyat to debate the Royal Commission of Inquiry (RCI) report on TH today. Zulkifli said TH and Al-Rawda entered into a settlement agreement in November 2024 in an effort to recover the outstanding amount. Under the agreement, Al-Rawda paid only 14.9 million Saudi riyals, equivalent to about RM16.2 million, before failing to comply with the settlement terms. "TH terminated the settlement agreement and continued efforts to recover the outstanding arbitration award, including by appointing a consultancy firm with expertise in asset tracing," he said. He said the Al-Rawda investment was among 14 problematic investments identified by the RCI, involving losses running into billions of ringgit. Between 2015 and 2017, TH leased four hotels in Makkah and Madinah from Al-Rawda and paid about RM1.55 billion upfront for lease periods of between 10 and 18 years. TH subsequently appointed Al-Rawda as the operator of the four hotels under management and operating agreements, with rental income amounting to 2.49 billion Saudi riyals. As security, TH received a promissory note personally guaranteed by Al-Rawda owner Dr Mashhor Ali Omar Al-Madudi. Zulkifli said the transaction was "unusual" and warranted scrutiny. He noted that the RCI has found weaknesses in TH's governance, including political influence, the appointment of active politicians to its leadership and investment decisions that exposed the institution to significant risks. The Dewan Rakyat convened for a one-day special sitting to discuss the RCI report, with proceedings beginning at 10am with Zulkifli's briefing, followed by a question-and-debate session involving MPs. The 211-page RCI report revealed governance weaknesses, including political interference in management and the distribution of profits without adequately accounting for depreciation and declines in investment fair value. It also found that TH should have recorded a net loss of RM1.4 billion in 2017, instead of the reported RM3.4 billion profit, had Malaysian Financial Reporting Standards (MFRS) been fully applied.
