No. A pocket rescission is illegal as we explained in our most recent decision on pocket rescissions. Congress holds the power approving a budget and appropriating funds. Presidents and executive branch agencies are responsible for administering funds.

The Trump administration is trying to use pocket rescissions to take back nearly a billion dollars that Congress already appropriated.

This is yet another attack on the legislative branch's spending powers.

Congress has to do everything it can to reclaim that power.

HOW THE RESCISSIONS ATTACK THE CONSTITUTION

Trump slashing roughly $800 million in spending on refugee resettlement, grants to migrant students and funds for minority businesses was an attempt to get around Congress’s spending authority.

This subverts the basic structure of the American system.

Congress already approved this money. The fiscal year ends today. The White House is trying to let $810 million expire without a vote.

Congress’s own watchdog says the law doesn’t allow that. The power of the purse belongs to Congress.
