TLDR: There is nothing enforceable for the immediate future. It will take months or years to implement this via rulemaking or bureaucratic changes which are then subject to legal challenge. While it's worrying, there's no immediate change yet for most trans people. Do not comply in advance.

It is really time to sue on the ankle monitor policy: it was issued as interim guidance rather than a notice and comment rulemaking. It also likely violates the 5th Amendment Due Process Clause.

Awful. Just awful. A promising young man, a high school honors grad who joined JROTC and dreamed of becoming a doctor, killed himself because of the Trump admin’s obsession with hurting Haitians and the humiliating shame of an ICE ankle monitor.

He then plugged the topic keywords into Gemini, which produced a document resembling a Notice of Proposed Rulemaking. It appeared, however, to be missing the actual text that goes into the Code of Federal Regulations, one staffer recalled. The presenter expressed little concern that the regulatory documents produced by AI could contain so-called hallucinations — erroneous text that is frequently generated by large language models such as Gemini — according to three people present. In any case, that’s where DOT’s staff would come in, he said. “It seemed like his vision of the future of rulemaking at DOT is that our jobs would be to proofread this machine product,” one employee said. “He was very excited.” (Attendees could not clearly recall the name of the lead presenter, but three said they believed it was Brian Brotsos, the agency’s acting chief AI officer. Brotsos declined to comment, referring questions to the DOT press office.)

Coming back to this thread on rulemaking. I expect RFK Jr to initiate a review of the essential health benefits required by the ACA. He will use rulemaking to remove mandated coverage for many services, with full support of insurance companies. Stay alert & prepare to push back as much as possible.

Laws are passed by Congress, or by state legislatures.

Executive orders aren't ruled either. Rules are issued by agencies after rulemaking processes, typically things like "notice and comment."

Consult a lawyer before you comply in advance.

A judge just issued a partial (but significant) ruling against the Seattle Police Department in the Seattle Times' lawsuit challenging SPD's "grouping" policy, in which SPD refuses to work on more than one records request at a time, giving false "placeholder" dates for every subsequent request.

The Trump admin tried to use emergency rulemaking to erase the Board of Immigration Appeals, requiring that basically all appeals (which cost $1,000 to file!) be summarily dismissed without any review.

Thanks to our @immcouncil.org legal team and others, the rule is now BLOCKED!
