Make Supreme Court rulings optional?

The Supreme Court's "shadow docket" allows justices to effectively make rulings in secret without explaining their decisions.

Is it any wonder why so many do not trust the Roberts court?

Clarence Thomas likens old rulings that protect our rights to trains driven by monkeys.
You are a blight on the legal profession, Clarence. Precedents obviously can be overturned, or Plessy v Ferguson would still be followed. But you know, or should know, that stare decisis enables a degree of stability in the law, vs changes w/ each administration.

Since April 4, #SCOTUS has issued 15 rulings on 17 emergency applications filed by Trump (three birthright citizenship apps were consolidated).

It has granted relief to Trump ... in all 15 rulings.

It has written majority opinions in only 3.

Today's order is the 7th with no explanation *at all.*
Here we go again: Over an acerbic dissenting opinion by Justice Sotomayor (joined in full by Justices Kagan and Jackson), #SCOTUS, with no explanation, grants a stay in the Department of Education RIFs case—effectively clearing the way for the Trump administration to dismantle much of the agency:

So he's saying people should ignore his rulings?
JUST IN: Senate Republicans have confirmed Emil Bove to a lifetime federal judgeship, choosing to ignore credible allegations that Bove had told Justice Department attorneys to defy court orders and say “fuck you” to judges who ruled against them. www.huffpost.com/entry/senate...

Bove faced credible allegations of telling DOJ attorneys to defy court orders. Republicans confirmed him to a seat on a U.S. appeals court anyway.

Chief Justice Roberts has the nerve to whine about detractors suggesting “political bias in the judge’s adverse rulings without a credible basis for such allegations.”

The gaslighting is real.

MacFarlane: There’s a sense that these court rulings—which have tried to disenfranchise or dilute the power of Black voters—will backfire.

That a wave already forming on behalf of Democrats is going to grow stronger and fiercer because of the court rulings.

- Religious exception rulings apply only to the plaintiffs.

- Environmental regulations continue to be enforced despite rulings against them (just not against plaintiffs).

- and on and on.

The left has to use this decision, not just criticize it.

It'll be chaos, but that's what the Justices get.

Comparing Supreme Court rulings that deal with people with rulings that deal with capitalism is very revealing. It’s money that matters.

Umm… no.

We expect more rulings on emergency applications as soon as Monday.

Total number of substantive #SCOTUS rulings on Trump emergency applications since 1/20/25: 32

Rulings with dissents from 2+ Democratic appointees: 22

Rulings with dissents from 2+ Republican appointees: 5

The mail-in ballots ruling is a big one, but let's not lose sight of the denominator here.

Again, this president & his officials do not follow laws or court rulings, & the solution to that is not more laws or court rulings.
And to be clear, everyone was very aware that this was illegal, but Trump officials and DOGE didi it anyway. Multiple IRS acting commissioners were removed when they raised concerns. Pretty much the entire C-suite resigned. From last year: donmoynihan.substack.com/p/this-tax-d...
