The reason why I ask is because the 9th Circuit held literally that "Sleekcraft" and "Slickcraft" are close enough to be reasonably likely to cause confusion.

Yeah if you're just doopa-dooing through a brief you don't check all the molding and floorboards. I admit, I don't double-check the pincite on the Polaroid/Lapp/DuPont/Sleekcraft factors every time I get a starting draft.
So it's a likely close to correct statement of law, in a less-critical part of the argument. That's the exact circumstance where someone overworked and in a hurry is going to be most inclined to cut corners.
After all, if it's got the law right, intuition says the case is likely OKish.
