Start with Trumbull. Ilan is referring to a private letter from Trumbull to Andrew Johnson that was discovered by Mark Shawhan. In it, Trumbull interprets the Civil Rights Act of 1866 to cover children born of domiciled parents. It's telling that Shawhan REJECTS a domicile requirement. 1.

So, the scholar who shared it with Hyman is Mark Shawhan. Who wrote an earlier article about this letter. And then in a subsequent article about the original meaning of the Citizenship Clause said that the letter IS NOT probative of original PUBLIC meaning because it's an effing private letter.

Minor addendum: it’s not a note. It’s a comment. 15 pages max. Not a full article by any stretch. And in a full article Shawhan said the letter was irrelevant.

The whole thing is just so sloppy. It's a cite-dump, not a serious canvassing of relevant scholarship. It ignores, inter alia, Bethany Berger, Mark Shawhan, Matthew Ing, and specific critiques of Schuck and Eastman that number in the double digits.

The Michigan Tech athletic department pulled off something of a miracle Thursday morning: they made a drastic personnel announcement without a single member of our notoriously nosy staff hearing a peep about it. After eight seasons at the helm of Huskies hockey, Michigan Tech has parted ways with head coach Joe Shawhan. He leaves Michigan Tech as the institution's second-winningest coach of all time (154-120-29), behind only the immortal John MacInnes (555–295–39).

I will say a bit more about the domicile thing but not this evening. Shawhan relies very heavily on a private letter between Lyman Trumbull and Andrew Johnson which is only available on archival form. I don’t think there’s much there. The point is that even if there is, it doesn’t help the EO.
