The 3 part test is the RJR-MacDonald test.

Examples:
MacMillan Bloedel Ltd. v. Mullin;
Namgis First Nation v. Canada;
Taseko Mines Limited v. Canada
Not in BC. No automatic legal rule that halts construction when being litigated. To do so, you need to apply for an Interlocutory Injunction which has to meet the SCC’s three-part legal test which is the following:
ii) Irreparable Harm;
iii) Balance of Convenience.

He assured us consultation with us, the public, and First Nations would be thorough.

The Taseko mine at Fish Lake near Williams Lake was a tipping point. Mine thought they could bulldoze through and make lake into tailings pond. Environment Canada said "no.". Instead of changing plan they lobbied BC premier Christy Clark. 2nd "no" from Canada. The game has changed.

Good to see this expression of indigenous free prior informed consent being respected, and congratulations to the Tŝilhqot’in nation in Canada.

However, as with similar cases (like Jabiluka in Australia) they are hard-won victories after long struggles.

The Ulkatcho First Nation & Cariboo Regional District have rescinded multiple Evacuation Orders & Alerts due to #BCWildfire. Evacuation Alerts remain in effect for the Eliguk Lake, Holtry Creek, Scum Lake & Xeni-Taseko areas. An Evacuation Order is in place for the Tsetzi Lake Fire area.

Teseko finally gave up on Fish Lake, I guess. I don't know anything about this new mine, but hope they're being less bullheaded.
Fish Lake would have been a tailing pond, if mine had gone through.
