He is imposing these under Section 301 of the 1974 TradeAct, which does give the President the authority to impose tariffs in response to evidence of unfair trade practices. But of course, he’s pushing the boundaries here, since there is little evidence of those in the Brazil case.

After this ruling, the cleanest unilateral fallback is Section 122 (Trade Act ’74)—a narrow tool allowing tariffs up to 15% for up to 150 days to address balance‑of‑payments problems. ⏳📉
