BREAKING: After a Ninth Circuit panel earlier Monday voted 2-1 to block a district court TRO protecting election workers from DOJ/DHS intimidation, the full Ninth Circuit late Monday announced it would rehear the matter en banc—which takes the panel opinion off the books & keeps the TRO in place.

There is no notice of appeal from DOJ yet as to this TRO, but I don't see service to DOJ yet and DOJ did not file any opposition. Granted the day it was filed, this appears to be an actual ex parte TRO.

This was a draw from hell, and I wonder if they hold another vote for the actual full court to consider this truly en banc, then grant that and vacate the limited en banc order, keeping the TRO in effect at least through today.

To be honest, I'm not sure that some of this TRO is really something a judge can order.
It’s gonna be hilarious when DOJ appeals arguing that the District Court should NOT require DOJ to stop threatening election officials with criminal prosecution, retract previous threats, report to her all pending search warrant application/grand jury subpoenas related to ineligible voters

Requests are in to the Ninth Circuit in the SEIU case. Plaintiffs are seeking en banc review (to keep the TRO in effect; DOJ is opposing en banc review (letting the panel's order staying the TRO go into effect).
