3/ The Vought White House, which has adopted UET on steroids, is extending this to the proposition that only the president can identify national priorities, even in the teeth of countervailing statutory language.

That is personalist rule; it has nothing to do with rule by law.

Tbc this is a brand new argument. I’ve been reading UET stuff for a long time and I’ve never seen this move made. In all seriousness, it should immediately be added to the standard repertoire in the litany of problems with UET

Per Justice Thomas, 18c dictionaries had a verb meaning “to assign for EXCLUSIVE use”—ie, the exact thing imperial presidency fans wish the vesting clause said.

But that verb was NOT “to vest.” It was “to appropriate.” 🤔

3/ This means independent agencies like the Federal Reserve or FTC are considered unconstitutional by UET proponents. Their leaders are protected by "for cause" removal statutes, which proponents of UET aim to eliminate and SCOTUS appears open to.

2/ What is UET? In its strongest form, the unitary executive theory (UET) argues that Article II vests all executive power in the president. Proponents claim this gives the president absolute authority to direct and, most importantly, fire any official in the executive branch at will.

What has happened—for quite a bit—is that administrative law scholars suppressed our inclinations that UET was a crackpot theory because scholarship lets a thousands flowers flourish. Now, I am like: UET is a crackpot theory, based on a weird version of Rousseau’s General Will.

Interesting amicus brief by @democracyforward.org in Trump's $10b tax lawuit. They convincingly make the claim that there is no case or controversy if the President is on both sides of the litigation.

Aaaand, this is why I am concerned about UET: it is fantasy. Congress drafts the law that is executed by the President. The President has leeway in interpreting the law, but at the end of day, he can’t completely ignore it.
