I think Drew Ensign broke Judge Wilkinson
A colleague emailed me today to flag the fact that the superb Fourth Circuit Judge J. Harvie Wilkinson ended a quotidian insurance opinion with an unusually introspective conclusion.

This is from J. Harvie Wilkinson III, a Reagan appointee:
INCREDIBLE opinion by Wilkinson refusing to stay Judge Xinis's orders in the Abrego Garcia case, condemning DOJ's arguments as "shocking not only to judges, but to the intuitive sense of liberty that Americans far removed from courthouses still hold dear."

Yeah, just try calling J. Harvie Wilkinson a “Communist, left-wing judge” to his face, Stephen.

To put this extraordinary order in context, Wilkinson is a Reagan appointee.
Whew, this conclusion from the Fourth Circuit:

"We yet cling to the hope that it is not naïve to believe our good brethren in the Executive Branch perceive the rule of law as vital to the American ethos."

The opinion by Judge Wilkinson for the Fourth Circuit denying the government’s most recent request for a stay or mandamus against Judge Xinis’s rulings in the Abrego García case is especially powerful when you consider it was written by … Judge Wilkinson:

Tom Wilkinson carrying a comically large number of Claymores instead of baguettes (someone photoshop this)
Michael Claymore. Movie’s the same except George Clooney has a big two-handed sword. He does get into a brutal swordfight with Tilda Swinton before the recording reveal. Otherwise movie’s the same. Michael Claymore (that’s a type of large two-handed sword from Scotland. Claymore I mean not Michael)

Guynn: Need is not a factor in the analysis.

Xinis: Let me direct you to Sterling. This is Judge Wilkinson. [Quotes Wilkinson saying that in some cases the need may be great and showing weak such that in camera review may be required...]

The fact that Wilkinson wrote this is notable. He's a big name in conservative FedSoc circles...
NEW: The Fourth Circuit REJECTS the Trump admin's appeal of Judge Xinis's orders to "facilitate" Kilmar Abrego Garcia's release: "We shall not micromanage the efforts of a fine district judge attempting to implement the Supreme Court's recent decision." storage.courtlistener.com/recap/gov.us...

I met Wilkinson during production of "Constitution USA." Very conservative, but principled to the last.
